3. a. Describe the factors that affect the weight of a judicial precedent.
b. What do you understand by (a) Per Incuriam (b) Obiter dictum .
4. “To succeed in the profession of law, you must seek to cultivate command of language; words are the jurist tools of trade. The reasons why words are so important are because words are the vehicle of thought……obscurity in thoughts inexorably leads to obscurity in language….”per Lord Denning.
i. In the light of the above quotation discuss the importance of language to law.
ii. Give 5 examples of ambiguities associated with language in the drafting of legal documents
5a. Law is the restraining factor in the exercise of man’s freedom: if not, man would have long returned to the state of nature. Discuss.
b. Differentiate between deductive and inductive logic.
